Creator Program Terms and Conditions

The following terms and conditions apply to participation in the POCASIO Creator Program.

Through this Creator Program, you have the opportunity to present advertising from MCS Online Solutions GmbH, Waldhofstr. 19, 25474 Ellerbek, Germany (hereinafter referred to as “POCASIO”) on your social media channels (hereinafter “Social Accounts”) and thereby generate advertising revenue.

1. Participation and Registration

(1) Persons aged 18 or older are eligible to participate, provided they have an active, public social media profile on Instagram, TikTok, or YouTube, and the content is thematically relevant (e.g., house construction, renovation, finance).

(2) Registration is completed via the corresponding registration form. After reviewing the profile, POCASIO may, at its sole discretion, reject or approve participation.

(3) By submitting your registration, you accept these terms and conditions.

2. Content & Publication

(1) You are solely responsible for creating content relevant to the POCASIO app on your channel. The content must have a positive, authentic, and respectful connection to the POCASIO brand.

(2) Content that is not permitted includes:

misleading, offensive, or defamatory,
portrayed satirically or negatively towards POCASIO,
violates applicable law or third-party rights,
uses artificially generated (e.g., bots) or purchased reach.

(3) The content must be published on your own channel. POCASIO reserves the right to subsequently exclude content from remuneration if it violates these terms.

3. Remuneration & Payout

(1) Remuneration is based on genuine organic video views, according to the remuneration table valid at the time of publication (see below).

(2) You submit the link to the published post, including proof of reach (e.g., screenshot), via the submission form or by email.

(3) Payouts are usually made within 14 business days via bank transfer.

(4) Parallel participation in the Affiliate Program is possible. For users referred via your personal referral link, you will additionally receive a 25% lifetime commission according to the terms therein.

4. Usage Rights

(1) You grant POCASIO a simple, non-transferable, geographically and temporally unlimited right of use for the submitted content, to use it within the scope of corporate communication (e.g., website, social media, newsletter) for promoting the Creator Program.

(2) You remain the owner of all other rights to your content.

5. Exclusion and Termination

(1) Participation in the Creator Program is indefinite, unless otherwise agreed.

(2) You may terminate your participation at any time informally by email to info@pocasio.com.

(3) POCASIO may also terminate participation at any time without stating reasons. In the event of violations of these terms and conditions or a justified suspicion of misuse, exclusion may occur immediately and retroactively.

6. Liability

(1) You warrant that you possess all necessary rights to the content you create. You fully indemnify POCASIO against third-party claims resulting from a violation of these rights.

(2) POCASIO is liable only in cases of intent or gross negligence.

7. Final Provisions

(1) You will be notified of changes to these terms and conditions in a timely manner.

(2) German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(3) The place of jurisdiction is – to the extent legally permissible – the registered office of MCS Online Solutions GmbH. The following terms apply to participation in the POCASIO Affiliate Program.
